Gugushev & Partners Law Office on Directive (EU) 2019/1937 of the European Parliament

Directive (EU) 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law obliges the Member States to transpose the rules of the Directive by 17 December 2021.

The Directive sets common minimum standards to ensure a high level of protection for individuals in the private and public sectors who report breaches of Union law.

The process of transposing the Directive into our legislation is at an early stage and may not be finalized before the deadline set by the European Parliament and the Council. However, the lack of transposition does not restrict persons for whom the Directive creates rights from invoking it against the State after the set date.

We at Gugushev & Partners Law Office believe that good preparation and the provision of clear legal advice are the keys to the smooth development of any business, and that is why we have prepared this brief legal review.

- What are the general obligations when submitting a signal?

- What is the protection of those who expose the violation?

- What are the sanctions provided for in the directive?
